Reference: JHB003215-LdS-1 Responsible for the day-to-day legal, compliance and risk management responsibilities of the Property Management Company, in respect of the Company's own operations as well as the management of the retail, commercial and industrial building portfolios under its management. This role will support and report directly to the CEO. The role will focus strongly on the compliance requirements set by the Financial Intelligence Centre (FIC) Act, and executing the Company's risk management and compliance programme (RMCP) in seeing to same. REQUIREMENTS: LLB degree and admitted attorney of the High Court. 1-3 years' experience post admission as attorney of the High Court. Business and legal writing skills (including skills to draft agreements, legal correspondence & legal opinions) Experience in the Property Industry is preferred. DUTIES: Legal advisory: Lease & sale transaction advice; Drafting, perusing, vetting, negotiation and settlement of related lease, sale and other documentation & agreements pertaining to Company; and Statutory, regulatory and other legal advice to meet Company and Building / Client requirements. Compliance: Formulation, implementation, oversight, and review of statutory and regulatory compliance pertaining to the property environment. E.g. - FIC Act, including the money laundering compliance officer (MLCO) function & RMCP duties; Property Practitioners Act and Regulation; Protection of Personal Information Act (POPI Act); Consumer Protection Act (CPA); and Occupational Health & Safety Act (OHASA) & Regulations. Formulation, implementation, oversight, and review of the Company policies Risk management: Risk mitigation via applicable insurance products; Policies – refer to above; and Fulfilling the MLCO role in ensuring that the Company complies with the FIC Act, with duties set out in the Company RMCP. Corporate & client governance: Ensuring that all client mandates/resolutions are in place and signed, as well as ensuring that all management meeting agenda and minutes are drafted, circulated and issued timeously. Stakeholder management: Engage and maintain good relations with all Buildings' stakeholders, including - Owners; Team; Service providers and contractors, including security, cleaning and facilities' suppliers & vendors; Regulators and governmental bodies: E.g. engagement with the Property Practitioners Regulatory Authority (PPRA), FIC, Information Regulator, local authority etc; and Transactional: Negotiate and conclude lease transactions PPRA: The successful candidate will be required, once appointed, to register with the PPRA as a candidate property practitioner and successfully complete the PDE4 qualification within the timeline prescribed by the PPRA to become a full-status property practitioner.
