To initiate all proceedings to minimise bad debt. DESCRIPTION OF TASKS - Assume responsibility for a portfolio of non-performing accounts, undefended and defended litigation. - Attend to settlement negotiations on legal matters. - Attend meetings with clients and consultations with attorneys and counsel. - Negotiate, monitor, and report on payment arrangements. - Manage all Rental Legal Accounts in conjunction with the relevant parties, in a manner which ensures maximum recovery to the Bank in the shortest possible time frame. - Manage, monitor, update and report on all legal accounts handled by our attorney(s). Decide on action to be instituted and instruct accordingly. - Monitor insolvencies-liquidations, sequestrations, business rescues, offers of compromise, curatorship etc. Submit claims, monitor dividend payments, check liquidation and distribution account for possible undue preference or dispositions, call for advanced dividends etc. - Explore, pursue, and realise all avenues of recovery to maximum benefit to the Bank. - Manage and contain all internal & external costs associated with the collection of outstanding agreements. - Recommend write offs to Credit Committee after all avenues of recovery have been exhausted. - Assist with the monthly impairment calculations and reporting to the company. SKILLS/PERSONAL ATTRIBUTES REQUIRED - Paralegal diploma or equivalent. - Soft legal background with exposure to litigation. - Sense of urgency, proactive. - Excellent written and verbal English communication skills - Excellent understanding of debtor accounts, (specifically rental & lease agreements) - Knowledge of the legal process / insolvency and all legislation surrounding the collection of debts - Knowledge and understanding of magistrates and high court procedures. - Knowledge and understanding of cession agreements - Excellent interpersonal skills - Good knowledge of MS Office / Excel - Must be able to work in a team
