Location: Sandton & servicing Mbombela client with a possibility of being transferred to Nelspruit office. Purpose of the Role: This role is for supporting the Director (where required) and the Senior Associate of the firm in rendering Dispute Resolution which includes commercial litigation, arbitrations, recoveries and insolvency procedures and business rescue services to clients. This role involves providing legal advice and representing with or without Counsel Clients in applicable forums regarding potential disputes or conflicts. Assessing the legal merits of a case, providing strategic advice on potential courses of action, and helping clients understand their rights and options under the law. Responsibilities are but not limited to: The employee's duties are but are not limited to the following: Consultations and taking instructions from a client in the office, client's office and any other place as arranged with clients. Preparing for and attending a meeting with clients and other attorneys. Conducting legal research and drafting internal offices memorandum or advice to clients. Drawing and compiling briefs to advocate and/or consultants and to consulting with them. Drawing pleadings, notices and affidavits for litigation in the superior courts or arbitration forums; Appearing with counsel at the superior courts and /or arbitration; Appearing in Magistrates Court for trial and applications; Drafting general legal opinions and memorandums of advise; Drafting, reviewing, vetting and negotiating settlement agreement Drafting monthly reports to clients and reporting orally on matters to the director and or Senior Associate Posting of fees for hours worked on GhostPractice. Key Skills required Knowledge of contractual disputes - detailed knowledge of law of contract. Company ownership / directors disputes - detailed knowledge of corporate law. Corporate insolvency (curatorship, liquidations, money claims, business rescue & recoveries) - detailed knowledge of laws applicable to insolvency / recoveries and processes Arbitrations and litigation - detailed knowledge of procedural rules for arbitrations and court litigation with ability to appear on unopposed motions Attributes Exceptional ability to diagnose problems and design solutions for such problems within applicable laws. Risk identification and mitigation. Adequate Commercial/business acumen. Creative and positive mindset with strong attributes of lateral thinking.
