Location: Parktown, Johannesburg A position is available for an energetic individual with a legal background to join our client's Legal Team. The purpose of this role is to provide the business with accurate and relevant legal and compliance support. Our client is a leader in specialist risk insurance with a focus in construction, customs, fuel guarantees, mining rehabilitation guarantees, and credit insurance. Legal Support: Draft, review, interpret and advice on underlying contracts and other legal documents. Assessing, approving guarantee and related contracts and wordings. Advise on a variety of legal issues and legal risks, that will have an impact on the businesses. Legal advice to the business on impact of underlying contracts on facilities and securities in consultation with the underwriter. Legal advice to businesses on applicable securities to protect the business. Negotiating guarantee terms with clients and beneficiaries. Assist underwriters with approval and processing of guarantee applications (wordings & security signoffs). Facilitate all cancellations and reductions of guarantees, in strict compliance with guarantee wording - Liaise with brokers and clients on related queries. Securities: Advise underwriters on appropriate security and collateral for facilities. Ensure standard templates are up to date with new legislation, case law, market trends. Draft once-off client/project specific security documents. Negotiate terms of security documents as and when required. Assist with general drafting of in-house security documents. Manage external attorneys on outsourced security documents. Approve all new security documents on internal systems and ensure that the physical and virtual file are align. Form part of the development of internal systems in respect of securities and ensure the accuracy of data on such systems. Assist with security releases. Attend to security audits annually. Claims & Recoveries: Assess received claims on an ad-hoc basis. Recover overdue premium and claims paid by being actively involved in the recovery and salvaging process (Sending letters of demand, instructing external attorneys and managing the legal process). Draft AODs and Repayment plans; monitor and enforce AODs. Compliance: Ensure the company meets group compliance requirements. Assess business implications and implement new legislation as and when necessary. Facilitate execution of any recommended corrective actions, outstanding monitoring issues and management actions. Create a level of compliance risk awareness within the company. Update business on new legislation, market trends. General: Identify process shortcomings and develop and implement appropriate workflows. Research relevant legal topics, write legal opinions and provide training to business. Contribute to monthly legal updates/team development meeting. Liaise with clients and beneficiaries in a professional manner to strengthen the company's brand. Qualifications: LLB Post graduate degree or equivalent in commercial, contract or insurance law will be an advantage Knowledge and experience: Admitted attorney. 3 – 5 years' experience in the commercial, insurance and/or banking sector. A thorough understanding of guarantees will be an added advantage.
